1. Who we are

The Crochet App mobile application (the “app”), the website newcrochet.store and its pattern shop (the “shop”), and the creator console at admin.newcrochet.store (the “creator console”) — together, the “Service” — are operated by SIA “Crochet App”, a company registered in the Commercial Register of the Republic of Latvia under registration number 40203493865, with its legal address at Čiekurkalna 2. līnija 4-1, Rīga, LV-1026, Latvia, VAT number LV40203493865 (“we”, “us”, “our”).

You can contact us at hello@newcrochet.store, including for copyright and other content complaints (see section 12).

2. Accepting these terms

By downloading or using the app, the shop or the creator console, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the Service. Our Privacy Policy explains how we handle your personal data and forms part of these terms.

If you buy or sell patterns in the community marketplace, sections 7 to 13 also apply to you. Where these terms say “Creator”, they mean a user who publishes patterns through the creator console; “Buyer” means a user who obtains a community pattern, whether paid or free.

3. The app and our intellectual property

You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to SIA “Crochet App”. Patterns written by Creators belong to their Creators, as described in section 9.

SIA “Crochet App” is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

4. Your account and your device

Some features require an account. You must give accurate information when you create one and keep your sign-in details secure. You are responsible for activity on your account. The Service is not intended for children under 13. Buying patterns requires you to be an adult or to have the consent of a parent or guardian, and becoming a Creator requires you to be at least 18.

The Crochet App app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Crochet App app won’t work properly or at all.

5. Third-party services

The Service uses third party services that declare their own Terms and Conditions, including:

  • Google Play Services
  • Google Analytics for Firebase and Firebase Crashlytics
  • Apple App Store and Google Play billing, for app subscriptions
  • Stripe, for payments in the shop and payouts to Creators

6. Things we are not responsible for

You should be aware that there are certain things that SIA “Crochet App” will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but SIA “Crochet App” cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, SIA “Crochet App” cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, SIA “Crochet App” cannot accept responsibility.

With respect to the responsibility of SIA “Crochet App” for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. SIA “Crochet App” accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

7. The community marketplace

The community marketplace lets independent Creators publish crochet patterns (“Community Patterns”) that Buyers can obtain, either for free or for a price, and read in the app.

Community Patterns are written and published by their Creators, not by us. We provide the platform: we host the patterns, process payments, collect and pay tax where required, deliver patterns to Buyers and pay Creators their share. Each Creator is solely responsible for the content of their patterns — including their accuracy, originality and lawfulness. A Community Pattern is identified as such and shows the name of its Creator.

Before a Community Pattern is published, our team reviews it. That review checks whether the pattern is complete, readable and suitable for the marketplace. It is not a check of who owns the pattern, and it does not verify that the pattern is free of third-party rights. Approving a pattern is not an endorsement of it, nor a confirmation that it is accurate, original or lawful. We may decline to publish any pattern, and we may unpublish one at any time, for example if it breaches these terms or if we receive a complaint about it.

Community Patterns are separate from the Crochet App subscription. A subscription unlocks our own premium patterns; it does not include paid Community Patterns, and buying a Community Pattern does not give you a subscription.

8. Buying patterns

Where you buy. Paid Community Patterns are sold through the shop on our website, not inside the app. You must be signed in with a Crochet App account to buy, and the pattern is added to that account. Guest and anonymous accounts cannot buy patterns.

Price and payment. Prices are shown in US dollars. Any VAT or sales tax that applies is calculated from your location and shown before you pay. Payment is processed by Stripe; we do not receive or store your full card details. SIA “Crochet App” is the seller of record for each purchase and issues the receipt.

Delivery. Once your payment is confirmed, the pattern is added to your account and becomes available in the app. If a purchase does not appear in your account, contact us and we will resolve it.

Your right of withdrawal. A pattern is digital content that is supplied immediately. Before you pay, you will be asked to agree that delivery starts straight away and to confirm you understand that you then lose your 14-day right to withdraw from the purchase. If you do not give that consent, you cannot complete the purchase. This does not affect your rights if a pattern is faulty or not as described.

Refunds. Because of the above, purchases are not refundable once delivered, except where the law requires it — for example, if a pattern is missing, cannot be opened, or is materially different from its description. Please contact us within a reasonable time if that happens. We may also grant a refund or a replacement as a goodwill gesture, at our discretion.

What you get. When you obtain a Community Pattern, you receive a personal, non-exclusive, non-transferable licence to use it for your own crafting, for as long as your account exists and the Service is available. You may not copy, share, upload, resell, translate or otherwise distribute the pattern, or any substantial part of it, to anyone else. Whether you may sell items you make from a pattern is decided by its Creator; where the pattern page says nothing about it, you may sell handmade items made from it in small quantities, crediting the Creator.

If a pattern is removed. A Creator may stop selling a pattern, and we may unpublish one. A pattern you have already obtained normally stays in your library. If we are legally required to remove a pattern from Buyers’ libraries — for example because a court or a valid complaint establishes that it infringes someone’s rights — we will do so, and where you paid for it we will consider a refund or credit on a case-by-case basis.

9. Selling patterns: Creator terms

Becoming a Creator. Creators must be at least 18 and provide accurate information about themselves. To be paid, a Creator must complete onboarding with our payment partner, Stripe, including any identity and bank checks Stripe requires, and accept Stripe’s Connected Account Agreement. Further operational terms are shown in the creator console (the “Creator Terms”) and form part of these terms.

Your patterns stay yours. You keep the copyright and all other rights in the patterns you publish. By submitting a pattern, you grant SIA “Crochet App” a worldwide, non-exclusive, royalty-free licence, for as long as the pattern is published and afterwards for the purposes described below, to host, store, reproduce, format, adapt for display on different devices, display, promote and distribute the pattern and its images through the Service, and to sublicense it to Buyers under section 8. Licences granted to Buyers before a pattern is removed continue after removal, unless the law requires otherwise.

Your promises. By submitting a pattern, you confirm that:

  • the pattern, its text, charts and photos are your own original work, or you hold all the rights and permissions needed to publish and sell it;
  • it does not copy or adapt another designer’s pattern without their written permission;
  • it does not infringe any copyright, trademark, design right or other rights of anyone else — including characters, logos and brands owned by others;
  • anyone recognisable in your photos has agreed to their publication;
  • the information you give about the pattern (difficulty, materials, sizes and similar) is accurate to the best of your knowledge; and
  • the pattern does not contain anything unlawful, harmful or misleading.

Your responsibility. As the author and publisher of your patterns, you are legally responsible for them. If a third party makes a claim against SIA “Crochet App” because a pattern you published infringes their rights or breaks the law, you agree to compensate us for the losses, costs and reasonable legal fees that result, to the extent the claim is caused by your breach of these terms.

Prices. You choose a price from the price tiers available in the creator console, or publish a pattern for free. We may change the available tiers with notice.

Your earnings. For each paid sale, you receive a share of the net revenue — the amount the Buyer paid, less taxes and payment processing fees. The current share, the holding period before earnings become payable, any minimum payout amount and the payout schedule are set out in the Creator Terms in the creator console. Payouts are made through Stripe to the account you connected. If a sale is refunded or charged back, the corresponding earnings are reversed, including from future payouts.

Taxes. You are responsible for declaring and paying any tax due on your earnings. EU law (the DAC7 directive) requires us to collect certain information about Creators — such as name, address, date of birth, tax identification number and bank account — and to report Creators’ earnings to the State Revenue Service of Latvia, which may share it with the tax authority of your country. We may withhold payouts until the information required by law has been provided.

Changes to Creator terms. We will give you at least 15 days’ notice before changing the revenue share, the payout rules or other terms that apply to Creators, unless a shorter period is required by law or for security reasons. Changes do not apply to sales made before they take effect. If you do not agree to a change, you may stop selling and close your Creator account before it takes effect.

10. Rules for everyone

When using the Service, you must not:

  • share, upload, resell or otherwise distribute patterns you do not own, including patterns you bought;
  • publish content that infringes anyone’s rights, or that is unlawful, hateful, misleading or sexually explicit;
  • attempt to get around payments, access controls or limits on the Service, or scrape or copy content from it in bulk;
  • create accounts in someone else’s name, or use the Service to defraud anyone.

11. Suspending accounts and removing content

We may remove or restrict access to content, or suspend or close an account, if we reasonably believe that it breaches these terms or the law, or to protect Buyers, Creators or the Service. Unless the law or a security risk prevents it, we will tell the person affected what we did and why, and they may reply to us to contest the decision. We will review a reply and tell them the outcome.

We may suspend or close the accounts of users who repeatedly publish infringing or unlawful content, or who repeatedly submit unfounded complaints.

12. Reporting copyright infringement and illegal content

If you believe that a Community Pattern infringes your copyright or other rights, or is otherwise illegal, please email hello@newcrochet.store with:

  • the link to, or the name and Creator of, the pattern concerned;
  • an explanation of why you believe it infringes your rights or is illegal — for copyright, a description of your original work and, if possible, where it was first published;
  • your name and email address; and
  • a statement that you believe in good faith that the information in your notice is accurate and complete.

We will confirm that we received your notice, review it diligently, and may restrict access to the pattern while we do. We will tell you what we decided, and we will tell the Creator too. We may share your notice with the Creator so they can respond; let us know if you would like your contact details kept from them. Submitting a notice you know to be false may make you liable for the harm it causes.

13. Disclaimers and limitation of liability

Patterns are provided as is. Community Patterns are written by independent Creators. We do not check them for errors, and we do not guarantee that a pattern is accurate, complete, or suitable for a particular purpose, nor that following it will give a particular result. Quantities of yarn, sizes and other details are the Creator’s estimates. Our own patterns are prepared with care, but the same applies to them.

We are not responsible for Creators’ content. We are not responsible for any infringement of third-party rights, or any other unlawfulness, in content published by Creators, unless we have been notified of it and have failed to act as section 12 describes.

Limitation of liability. To the extent the law allows, SIA “Crochet App” is not liable for any indirect or consequential loss, or for loss of data, profits or goodwill, and our total liability to you in connection with the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for intentional or grossly negligent conduct, or any other liability that cannot be limited by law, and nothing affects your statutory rights as a consumer.

14. App updates and ending the Service

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. SIA “Crochet App” does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you.

We may also wish to stop providing the app or the marketplace. If we do, we will give reasonable advance notice where we can, and we will tell you how you can keep using patterns you have bought. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

15. Subscription service

Subscription. You can subscribe on a monthly basis, or other periods that Crochet App may offer from time to time, and the applicable fees are those shown in the app store from which the Crochet App can be downloaded.

Eligibility for any promotions or discounts is settled at the time you subscribe and cannot be changed during the term of your subscription. You are responsible for reading and understanding the specific terms and conditions applicable to any promotions or discounts.

Crochet App reserves the right to revise and update the applicable fees for subscriptions (including the fees set out on the relevant app stores where you subscribe on), and the different subscription packages available, at any time at its sole discretion.

Free trials. We provide a free 7 day trial subscription, or other in case of promotion activities and other marketing events for a fixed period of time, as determined by Crochet App in its sole discretion. Unless otherwise stated free trials are only available to all Crochet App users who want to try out paid functionality for the first time. Crochet App reserves the right to cancel any trial subscription immediately if we become aware that the subscriber has already had a trial subscription on a different User Account or using a different email address. Furthermore, any attempts to register for a further free trial on the same User Account or using the same email address may result in you being charged for the applicable subscription fees. After the trial, your subscription will renew automatically at the full subscription price unless you cancel your subscription before the end of the trial. To cancel your subscription during the trial, please refer to the instructions set out below under “Automatic renewal of subscription”.

Payment details. You can pay the fees for your subscription through your account with the applicable app store (i.e. through in-app purchases in the Apple App Store or Google Play). The price of your subscription, as well as the currency in which your subscription is payable, will be specified during the order process, and may vary depending on your country of residence (according to the selected app store region).

When you purchase a subscription, you must provide us with complete and accurate payment information. By submitting payment details, you represent that you are entitled to purchase a subscription using those payment details. If we do not receive payment authorization or any authorization is subsequently cancelled, we may immediately terminate or suspend your access to your subscription. Crochet App reserves the right to contact the issuing bank/payment provider and/or law enforcement authorities or other appropriate third parties if there is suspicious activity.

Automatic renewal of subscription. Your subscription will automatically renew unless you cancel at least twenty-four (24) hours before the end of the current billing period. However, you may cancel your subscription at any time by navigating to your profile page and following the prompts to cancel your subscription. Upon such cancellation, you will still be entitled to access the subscription services on the Platform for the remainder of the duration that you have paid for.

Cancellation and refund of subscription fees. If you have subscribed for the Crochet App through the App Store / Google Play, the cancellation and refund of subscription fees will be governed by the applicable terms and conditions of that app store.

  • If you sign up for a free trial, you agree that the Cooling-off Period for the paid subscription that you are receiving the free trial in connection with ends fourteen (14) days after you start the free trial - if you use the Platform during the free trial and don’t cancel the paid subscription before the free trial ends, you lose your right of withdrawal; and
  • if you purchase a subscription, you agree that the Cooling-off Period is available for fourteen (14) days after you have paid for the subscription, but the Cooling-off Period expires once you use the Platform during that period.

To exercise this right, please contact the Crochet App team using the details set out in section 18 of these terms.

Following expiry of the Cooling-off Period, subscriptions are non-refundable and there is no right to refunds or credits unless required by Applicable Laws. Although you may notify us of your intention to cancel your subscription at any time, such notice will only take effect at the end of your then current subscription period, and you will not receive a refund.

16. Account and data deletion

In order to delete your Crochet App account from the app - navigate to the app → Profile → Account Details → Delete Account. You can also ask us to delete your account and data by emailing hello@newcrochet.store. Deleting your account removes your access to patterns you have bought. Our Privacy Policy explains what happens to your data, including the records we must keep by law.

17. Governing law and changes to these terms

These terms are governed by the laws of the Republic of Latvia. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country.

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page, and we will notify you directly of significant changes. Creators receive notice of changes as described in section 9.

18. Contact us

If you have any questions or suggestions about our Terms and Conditions, do not hesitate to contact us at hello@newcrochet.store, or write to SIA “Crochet App”, Čiekurkalna 2. līnija 4-1, Rīga, LV-1026, Latvia.
